DIGITAL MILLENNIUM COPYRIGHT ACT (DMCA) NOTICE

     The Sunnycast is owned by the Augustine Corporation, which is a distribution platform for music audios and videos. Sunnycast is sure to bring good and quality content to you through our platform and also providing you with different genres of music, you can select from. The Sunnycast is positive to not be involved in a case of copyright infringement without prior authorisation from the owner of the copyrighted material.

However, in a situation where such may occur, the Sunnycast has a format by which the owner can request a DMCA Takedown Notice of his/her copyrighted material.

 

     SUNNYCAST FORMAT ON HOW TO SEND A DMCA NOTICE.

For a DMCA takedown notification to be effective or operative, the notification of claimed copyright infringement must be in writing (either electronic, mail or paper letter communication) after which, must be provided to our designated agent. Understand that, the notice must possess the following criteria otherwise the Sunnycast will neither be liable for compliance nor held accountable if the expected action is not taken.

 

 A DMCA Takedown Notice must comprise of the following;

  • Clear identification of the copyrighted work alleged to have been infringed.
  • A description of the copyrighted material claimed to have been infringed, that is to be removed or disabled access, provided with information satisfactorily adequate to enable Sunnycast locate the material. Such as the HTML, URL, website etc. where the infringing material can be found.
  • Provision of information seemingly adequate to allow us contact you,(complaining party) which can either be an address, telephone number or an electronic mail address.
  • In your writing, the following statement must be prominent.
    • A statement that attest that you are the owner or authorized to act on behalf of the owner of the copyrighted material, identified in the letter and that the copyrighted material in question is allegedly infringed leaving you with the right to seek redress for such infringement.
    • A statement that shows a good faith belief that the use of the copyrighted material in the manner grumbled of is not authorized by you or any of your agents or by the law, following with a swear under the penalty of perjury that the information rendered is true and accurate.
  • The letter must be signed with a physical or wet signature ( that is, a pen or stamp) and can also be signed electronically.

 

Note that,

In a situation, where the notice does not comply with necessary criteria, then the notice is considered to be ineffective. Therefore, not considered as to providing the necessary knowledge to Sunnycast.
